TERMS AND CONDITIONS

These Terms and Conditions (“T&C”) governed the use of Services, through the website at www.izzyship.my provided by Izzyship (M) Sdn. Bhd. at No.16, Jalan Subang 7/4, Tmn Perindustrian Subang USJ 1, 47600 Subang Jaya Selangor Darul Ehsan, Malaysia. (“Izzyship”, “our”, “we”, “us”). By using our Services, you acknowledge that you have read and agreed to comply with all the terms and conditions stated herein. If you are not agreeable with any of these terms and conditions, you shall not proceed with our Services.

 2. SERVICES

  1. Services refer to the dropshipping services undertaken by Izzyship either by engaging its AIR FREIGHT service and SEA FREIGHT service. These Services shall include the processes of receiving, storing, sorting, repacking, consolidating and delivery of your Parcel and/or Cargo to the address in Malaysia provided you, pursuant to the T&C herein. However, the Services are exclusive of packing services

  2. The process of AIR FREIGHT Services is set out as follows:

    1. Firstly, you shall at your own accord, make the arrangement of shipment of Parcel to be delivered to Izzyship’s China warehouse.

    2. Once the parcel has arrived at Izzyship’s China warehouse, the Parcel will undergo our check-in process and thereafter you will be notified for payment via email. You will have the choices to make payment via Izzyship’s E-wallet, Interbank Giro, Duit and by cheque. Once you have made the payment, our system generates a shipment order and a Consignment Note for your reference. For avoidance of doubt, each shipment order shall be limited to generate a single Consignment Note.​

    3. Thereafter, the Parcel will be shipped out by us to Izzyship’s Malaysia warehouse.

    4. Once the Parcel has arrived at Izzyship’s Malaysia warehouse, we shall proceed to make the arrangement for last mile delivery to the address provided by you.

  3. Izzyship’s SEA FREIGHT Services offer drop shipping services for both Small Parcel (consolidate process) and Bulk Cargo (non-consolidate process). The process of SEA FREIGHT Services for both Small Parcel (consolidate) and Bulk Cargo (non-consolidate) is set out as follows:​

    1. Firstly, you shall at your own accord, make the arrangement of shipment of Small Parcel and/or Bulk Cargo to be delivered to Izzyship’s China warehouse.

    2. Once the Small Parcel and/or Bulk Cargo has arrived at Izzyship’s China warehouse, the Small Parcel and/or Bulk Cargo will undergo our checks in process and thereafter you will be notified for payment via email. You will have the choices to make payment via Izzyship’s E-wallet, Interbank Giro, Duit and by cheque. Once you have made the payment, our system will issue a Consignment Note for your respective Small Parcel and/or Bulk Cargo which subsequently generates a shipment order and a Consignment Note for your reference. For avoidance of doubt, each Consignment note shall be limited to generate a single shipment order and a single Consignment Note.

    3. Thereafter, the Small Parcel and/or Bulk Cargo will be shipped out by us to Izzyship’s Malaysia warehouse.

    4. Once the Small Parcel and/or Bulk Cargo has arrived at Izzyship’s Malaysia warehouse, we shall proceed to make the arrangement for last mile delivery to the address provided by you.

3. PARCELS CONSOLIDATION ACCOUNT

  1. Upon receiving your order request, our system will review your order, check the contents of Parcel or Small Parcel, repack your Parcel depending on your choices i.e. materials, size, etc. We will notify you through Izzyship’s system once the Parcel or Small Parcel is ready for shipment. You may login to your Izzyship account to review its chargeable weight, total shipping costs, proceed to confirm the order and make payment thereafter.

  2. Notwithstanding the above, only Small Parcel or Parcel which fall under the measurement of (< 0.15m³ and/or <50kg) should proceed with the parcel consolidation process which requires your confirmation through placing an order request.

4. IZZYSHIP ACCOUNT IS NONTRANSFERABLE

  1. Izzyship may, on its own sole discretion, change or modify the T&C from time to time, with or without prior notice to all users.

  2. In the event any discrepancy arises between the Chinese and English versions of this T&C, the English version of the T&C shall prevail.

5. REGISTRATION OF A IZZYSHIP ACCOUNT

  1. To register and access Services, you shall provide all required documents including but not limited to application for registration (Superform 14), certificate of incorporation, name card or business card in accordance with our procedures at no charge, to be utilized solely by Izzyship for verification purposes in order to commence this agreement. You may register for an account with this link, http://izzyship.my/en/reg/enindex We reserve the right to verify all information provided by each user and you shall provide us with further documents and/or information at the request of Izzyship. Izzyship shall only approve any new user account registered by a natural person in its personal capacity or for and on behalf of a corporation pursuant to Izzyship’s satisfaction.

  2. We reserve the right to cancel, terminate and reject any unconfirmed Izzyship account, or a Izzyship account that has been inactive for more than one-year period, or if you have submitted inaccurate information, or if we have reasonable suspicion that your account may be used for any unlawful or fraudulent purposes.

  3. You are advised not to register more than one account except as otherwise permitted by Izzyship.

  4. You may from time to time participate in our promotional programs, including but not limited to our Customer Referral Program.

6. IZZYSHIP ACCOUNT IS NON-TRANSFERABLE
You shall not transfer or assign your Izzyship account or your account login details to any third party.

 

​7. SECURITY

  1. You shall be responsible for maintaining the confidentiality of your Izzyship password. You shall be responsible for safeguarding your devices from access by others, and to log out from the Izzyship website when your session is complete. You are responsible for any use of the Izzyship website and your Izzyship account made under your login and password.

  2. If you are aware of any unauthorized use of your Izzyship account or any security breach including but not limited to the disclosure or loss of password or theft of your Izzyship account information, you should notify Izzyship promptly. We reserve the right, in our own discretion, to change, cancel or suspend any password, username, or account if improper use or distribution is suspected. Subject to our right and discretion, we may allow you to set up a new account for the purpose of continuing use of our Services.

8. CONFIDENTIALITY AND PERSONAL DATA

  1. You shall be responsible for maintaining the confidence of all information and data relating to Izzyship, including but not limited to its Services, products, business affairs, marketing and promotion plans or other operations and its associated companies which are disclosed to you by or on behalf of Izzyship (whether orally or in writing) or which are otherwise directly or indirectly acquired by you from Izzyship, or any of its affiliate companies, or created here. You shall further warrant that such confidential information shall only be used for the Services, and shall not without Izzyship prior written consent, disclose such information to any third party nor use it for any other purposes.

  2. In the event that you are required to disclose any information in the circumstances set forth in clause above, you shall, to the extent it is lawfully permitted to do so, notify Izzyship of the information to be disclosed (and of the circumstances in which the disclosure is alleged to be required) as early as reasonably possible before such disclosure is to be made and shall take all reasonable action to avoid and limit such disclosure.

  3. Izzyship may collect and process your personal data in accordance with Izzyship’s privacy policy, Personal Data Protection Act 2010 ("PDPA") and all applicable laws. For avoidance of doubt, Izzyship’s privacy policy shall apply to all Services. Where applicable, you are hereby agreed and consented to Izzyship including but not limited to its subsidiaries and any of its affiliate companies collecting, using, processing and disclosing personal data as further described in our privacy policy and in compliance with the PDPA and all applicable laws.

  4. You acknowledge that Izzyship may disclose information concerning the Services of other parties to you in the course of the use of Services. You represent and warrant that you will only use such information solely for the purpose of using our Services and not for any other unauthorized purposes.

9. YOUR USE OF THE WEBSITE
You shall not use Izzyship website or Services for any fraudulent and unlawful purposes. At the sole discretion of Izzyship, we shall reserve the right to terminate or restrict your access to your Izzyship membership account and your use of Services, if in our opinion, that your use of Services may have violated any laws, infringement on another person’s rights, or breach any of the terms herein.


10. MALICIOUS CONTENT
You shall be responsible to ensure that you will not expose yourself to the risk of virus, malicious computer code or any form of interface which may damage your devices while accessing or browsing our website and we shall not be liable for any interference or damage to your own devices which arise with your use of Izzyship website.


11. INTELLECTUAL PROPERTY
Izzyship owns the copyright and all other intellectual property rights of the website. You are prohibited from commercializing, reselling, distributing, adapting, printing and publishing any information without our prior written consent. The entire website content, layout, design, texts, photos, information, arrangement, know-how, methodologies, processes and underlying source code and software are owned by Izzyship and are protected by copyright laws and intellectual property laws in Malaysia. Your permission to use our website shall not be treated as a license to use our intellectual property.


12. THIRD PARTY WEBSITES
You shall bear the risk of using third party websites, links and its content. Izzyship shall not be held liable nor responsible for any content or information concerning Izzyship obtained from any third-party website.


13. PRODUCTS ORDERED FROM MERCHANTS
For an order you placed with an online merchant, either through links on Izzyship website or directly from the merchant’s website, you shall make payment to the merchant directly for the item purchased and its domestic shipping cost to Izzyship’s China warehouse address (if any).

 

14. PURCHASE TRANSACTION SOLELY BETWEEN YOU AND MERCHANT

  1. Izzyship provides links that you may access from Izzyship website to direct you to merchants’ websites. We provide access to enable you to manage Parcel(s), product(s) or Cargo(s) that you purchased to be delivered to you to Malaysia. You are solely responsible for selecting and ordering the products from the merchant, and your purchase of a product is a transaction solely between you and the merchant, and Izzyship is not a party in such transaction.

  2. Izzyship makes no representations, warranties or guarantees regarding the quality or suitability of the products you purchased from the merchant or seller. We are not responsible for any failure of a merchant or seller to deliver your product to Izzyship’s China warehouse address, or to fulfil your order, or for any defects in any product you purchased, or any damage that any product may cause, or for any other failure of the product to meet your expectations. For avoidance of doubt, we do not engage in any communications with merchants or sellers regarding the exchange or return of product. Upon delivery of the parcel, you shall be responsible for any defective product or product that does not meet with your expectations. Izzyship shall not be liable for any form of indirect loss, consequential damages, or other indirect costs, that arising out of the dealings between you and the seller or merchant.

15. DISCLAIMER OF WARRANTY
Your use of Izzyship website and its content are at your own risk, they are provided on a “as is” basis without any representations, warranties or conditions of any kind, whether express or implied relating to any inability to access or interruptions during the access to your account or when conducting transactions due to unavailable networks, unreliable internet service providers, malfunctioning equipment, incompatible software, or other causes beyond Izzyship control.


16. NOTICES
Email, notices and information on the website will be the primary forum of communication. We will send notices and any other relevant information to you through the website or email address you provide us. You may also contact us by sending email to cs@izzyship.my for any enquiries.


17. SHIPPING CALCULATOR
The shipping calculator shall only provide an estimated shipping cost. The estimated shipping cost may not include any duties, taxes, custom charges, applicable fees, or surcharges. The actual shipping cost may be varied from the estimated shipping cost due to the changes in shipper or logistic company rates; changes in fuel surcharge imposed by the shipper or logistic company; changes in currency exchange rates; differences between the volumetric weights and the shipment’s actual weights; and discrepancies between the given information and actual product classification or value.


18. CORRECT ADDRESS
You are responsible to ensure that the Parcels, Cargos, goods, products and/or items ordered are correctly addressed to Izzyship's China warehouse address, including but not limited to your name and exact suite/unit number. Izzyship shall assume that the information that you have provided is accurate and is under no obligation to verify the accuracy of your address details. The delivery address shall only be limited to Malaysia.

 

19. LOGIN ACCOUNT AND DECLARED ITEMS
After obtaining the information of your tracking number and Logistic Company Name from your merchant or seller, you are advised to login to your membership account and provide us your tracking number and Logistic Company Name. This is necessary to minimize the risk of any unidentified Parcel and/or Cargo or recipient. At the same time, you must declare all items in your Parcel and/or Cargo with accurate product description including product name, type, quantity, and value. By providing your declared information in your Login Portal, you have consented and authorised Izzyship to open and inspect your Parcel and/or Cargo and its contents.


20. ACCURATE CONTENTS DECLARATION

  1. For the purpose of compliance with any law or regulation of any federal, state or local government in the origin or destination countries, you shall provide an accurate description of the Parcel and/or Cargo contents and value of your Parcel and/or Cargo. We will request a copy of the merchant invoice of your purchased product(s) for verification if necessary. However, you are solely responsible for the accuracy of all information you provide to Izzyship regarding the contents of your Parcel and/or Cargo and its value.

  2. You agree to indemnify and hold Izzyship harmless from any liability, under declaration of the contents and value of your Parcel and/or Cargo or any misrepresentation that you made. You acknowledge and agree that your shipment may be inspected at any time by the relevant authorities.

  3. Shipment with misleading product descriptions or under-declared value on the Parcel and/or Cargo contents may be seized or confiscated by the relevant customs authorities, who may dispute and correct the declaration, in such case, you shall be liable to pay for penalty, duty, tax, surcharge on special handling and additional shipping costs and any other costs incurred due to the above.

21. RECEIVING PROCEDURES OF THE SERVICES

  1. AIR FREIGHT (Parcel)

    • We do not provide any Cash On Delivery (“COD”) for our Services. After we have received the parcel delivered to our Izzyship’s China warehouse, we will notify you at your Login Portal. We will seek your instruction for the type of Services to be engaged by you with us for your Parcel to be delivered to the address provided by you upon the arrival of your Parcel at the Izzyship’s Malaysia warehouse. Every item in the Parcel must be declared through Place Order Request in the manner as set out in Clause 28 of this T&C before your parcel arrived in Malaysia. Once an order request has been made, you shall make the payment of shipment immediately via your Izzyship wallet account in order for us to proceed the release of shipment under your instruction.​

  2. SEA FREIGHT (Small Parcel)​

    • ​We do not provide any Cash On Delivery (“COD”) for our Services. After we have received the Small Parcel delivered to our Izzyship’s China warehouse, we will notify you at your Login Portal. We will seek your instruction for the type of Services to be engaged by you with us for your Small Parcel to be delivered to the address provided by you upon the arrival of your Small Parcel at the Izzyship’s Malaysia warehouse. Every item in the Small Parcel must be declared through Place Order Request in the manner as set out in Clause 28 of this T&C before your Small Parcel arrived in Malaysia. Once an order request has been made, you shall make the payment of shipment immediately via your Izzyship wallet account in order for us to proceed the release of shipment under your instruction.​

  3. ​SEA FREIGHT (Bulk Cargo)

    • We do not provide any Cash On Delivery (“COD”) for our Services. After we have received the Bulk Cargo delivered to our Izzyship’s China warehouse, we will notify you at your Login Portal. We will seek your instruction for the type of Services to be engaged by you with us for your Bulk Cargo to be delivered to the address provided by you or storage upon the arrival of your Bulk Cargo at the Izzyship’s Malaysia warehouse. Once the Bulk Cargo is recorded, weighted and container manifest is generated, an invoice will be produced. Izzyship will notify you via email and portal you shall make the payment of shipment immediately via your Izzyship wallet account in order for us to proceed the release of shipment under your instruction.​​

22. LOSS OR DAMAGE OF PARCEL AND/OR CARGO IN TRANSIT TO OUR WAREHOUSE FROM MERCHANT
Izzyship will not be liable for any Parcel and/or Cargo lost or damaged in transit from the merchant or seller to the Izzyship’s China warehouse. We reserve the right to refuse and reject any Parcel and/or Cargo delivery to Izzyship's China warehouse if, upon inspection by Izzyship the Parcel and/or Cargo is damaged or incomplete or any deformation, we will not accept the Parcel and/or Cargo delivered by the merchant or seller and will notify you for further instructions.

23. INSPECTION OF PARCEL AND/OR CARGO

  1. To ensure the safety of transportation, Izzyship has the right to open and inspect any Parcel and/or Cargo or part thereof, during storage or when preparing to consolidate your shipment, for security purposes, to verify compliance with the relevant laws, rules and regulations, and to confirm the description of Parcel and/or Cargo and other information you have supplied to us, without prior notice and without liability to you.

  2. Further, we are not obligated to inspect Parcel and/or Cargo for non-obvious or hidden damage or breakage, and we do not accept any responsibility for the accuracy of product descriptions and other information provided by you.

  3. We do not provide any Parcel and/or Cargo examination services, if there’s any issue related to content discrepancies or missing content, we are not liable for such incident, unless we have other arrangements with customers.

  4. If we discover that the description of the contents of the Parcel and/or Cargo or other information you supplied is inaccurate and incomplete, we reserve the right to refuse or reject to process such Parcel and/or Cargo.

24. UNIDENTIFIED AND PROBLEMATIC PARCEL AND/OR CARGO
In the event that the actual recipient of the Parcel and/or Cargo is unidentified e.g. if the customer marking, recipient's name and/or the suite number of the address is missing or misstated due to the merchant or seller or your own actions, it will be spurn instantly from our Services.

25. PROHIBITED AND RESTRICTED GOODS

  1. Izzyship shall not render the shipment of any prohibited and restricted goods under the International Air Transport Association Dangerous Goods Regulations (IATA DGR), International Maritime Dangerous Goods (IMDG) Code and any law or regulation of any federal, state or local government in the origin or destination countries other applicable laws, rules and regulations. This includes the following:

    • safe boxes/boxes incorporating goods such as lithium batteries or pyrotechnics;

    • kerosene, kerosene heater, electric kerosene heater;

    • compressed gases (flammable, non-flammable, or poisonous) such as butane, propane, scuba; diving cylinders, lighter fuels, or refills;

    • oxidising substances such as bleaching powder and peroxides;

    • flammable liquids such as paints and adhesives;

    • flammable solids such as sulphur or strike anywhere matches and articles that are easily ignited;

    • disabling devices such as mace or pepper sprays, with irritant properties;

    • poisons such as arsenic, cyanide, or insecticide;
      radioactive materials;

    • corrosive materials such as mercury (which may be contained in thermometers or blood pressure gauges), acid/alkaline wet batteries;

    • any other substances which, during a flight, present a danger not covered above, such as magnetised, offensive, or irritating materials;

    • hoverboards, self-balancing scooters, balance boards electric luggage scooters and similar devices that contain lithium batteries;
      lithium battery watt-hour rating exceeding 160Wh;

    • battery-powered lighters (e.g. laser plasma lighters, tesla coil lighters, flux lighters, and arc lighters) without a safety cap or means of protection;

    • live animals;

    • banderols/ tax stickers;

    • bullion (of any precious metal);

    • “cash like” negotiable instruments in bearer form;

    • complete firearms, ammunition, flares, explosives and weapons;

    • perishable items;

    • human remains or ashes;

    • illegal goods

    • imitation (replica) firearms, weapons, explosive devices or ammunition; or

    • stamps

  2. All Parcel and/or Cargo may be inspected or scanned for the purpose of customs clearance. If the Parcel and/or Cargo is found to be regarded as prohibited and restricted goods, the Parcel and/or Cargo may be confiscated and may not be transported. You shall be responsible to ensure that the Parcel and/or Cargo does not contain any prohibited and restricted goods. We shall not be responsible for any loss resulting from the handling of Parcel and/or Cargo or legal consequences by the customs.

  3. Customers shall bear all responsibilities for any prohibited and restricted goods that are detained by the customs. If it is seized by customs, customers shall pay the fine for the entire container and wait for customs to verify the entire batch. As such, the refund of such shipment will not be guaranteed.

  4. Izzyship shall only be responsible for the handling of goods on your behalf and does not bear any legal liabilities that arise from illegal goods and the dishonest reporting of goods such as cigarettes, alcoholic drinks, weapons, etc. You shall bear all responsibilities for the delivery of all prohibited and restricted items that are banned from the respective country.

  5. Izzyship does not provide any "payment upon arrival of Parcel and/or Cargo" or "payment upon pick-up" services.

  6. Izzyship only acts as a logistic provider and not to be held responsible for any illegal activities and/or actions by you.

26. CLASSIFICATION OF SENSITIVE / RESTRICTED GOODS

  • Valuable Goods

Valuable items are highly susceptible to theft, loss and/or robbery. If you insist to purchase such goods, you are obligated to label such items as sensitive goods to reduce the probability of it being stolen. We shall not be responsible for any loss resulting from the handling of Parcel and/or Cargo 
(Common Items: high-end goods, high-quality art pieces and decorations / jewellery, expensive accessories, etc)

  • Goods Containing Liquid​

All goods containing liquid are classified as restricted goods.
For example, a pencil is considered a general item, but a pen is considered sensitive goods if it contains ink which is liquid. Another example is that phone covers are considered general Parcel and/or Cargo, but some phone covers have liquid decorations. The phone cover with liquid decorations is considered sensitive goods.
(Common Items: pens, phone covers with liquid decorations, drinks, perfume)

  • Goods Containing Magnets

Items such as stationery, kitchen equipment, music equipment and other goods containing magnets or magnetic properties shall be classified as sensitive goods.
(Common Items: magnetic message board, magnetic nails, magnetic bendable rulers, magnetic whiteboard erasers, fridge magnets, earphone, headphones, radios, speakers, music box)

  • Goods Containing Lithium Batteries

All goods with built-in lithium batteries are considered restricted goods. You shall ensure that batteries are removed from the Parcel and/or Cargo before shipping.
(Common Items: watches, power banks, children's toys, computers, mosquitoes’ swatter, flashlights)
Electrical Appliances

All electrical appliances are classified as restricted goods.
(Common Items: fans, clocks, hair dryers, blenders, robot vacuum, rice cookers)

  • Electrical Appliances

All electrical appliances are classified as restricted goods.
(Common Items: fans, clocks, hair dryers, blenders, robot vacuum, rice cookers)

  • Goods in Powder Form

All goods that contain powder materials or in powder form are considered restricted goods. This applies to powders of all colours. For further verification and information, please contact our customer service at cs@izzyship.my
(Common Items: powder masks, powdered collagen, blush, flour, milk powder, medicine in powder form)

  • Cosmetic Goods & Products

Products that are applied on the face and body are all considered restricted products.
(Common Items: lipstick, foundation, toothpaste, sunscreen, ointment, beauty mask, face cream, cosmetics, etc.)

  • Electronic Goods & Products

Goods that contain electronic chips are considered as restricted goods. These electronic chips are commonly found in 3C products, digital products or electronic appliances.
(Common Items: electronic thermometer, early childhood education machines, toys, electronic kitchen scales computers, pen drives, hard disks, SD cards, car GPS, electronic maps, etc)

  • Printed Items

It includes non-religious, political, ethnic, terrorist, erotic printed items with approved certificates.

  • Perishable Foods

All perishable food is considered as sensitive and we shall not ship any perishable goods except as otherwise permitted by Izzyship.
(Common Items: vegetable seeds, tea leaves, snacks, dried fruit etc.)

  • Goods containing a blade or tool item

Any products containing blades, be it stationery, kitchen utensils or personal care, are considered restricted products. Thus, it is recommended to use sensitive shipping.
(Common Items: kitchen knife, knife sharpener, penknives, scissors, peeling knife, barber knives, shaving knives)

 

27. PARCEL AND/OR CARGO CONTAINING PROHIBITED ITEMS

  1. Izzyship shall hold all Parcel and/or Cargo that are prohibited or restricted for export or import from and to the origin and destination country. Additionally, any Parcel and/or Cargo that is deemed unsafe for international transportation will be prohibited for shipment and placed on hold. Please refer to our Prohibited items/Items Category at Clause 25 for items which will not be accepted by Izzyship to ship.

  2. For prohibited goods, Izzyship reserves the right in its sole discretion to dispose of, submit to authorities or return such goods to the sender at your expense.

28. PLACE ORDER REQUEST

  1. Izzyship shall have the sole discretion not to proceed with your order request in the event of any non-compliance with the T&C herein, including but not limited to providing incomplete and inaccurate information of all item’s description in your Parcel and/or Cargo or goods that falls under prohibited and restricted goods; or if the top-up was made less than the indicated amount in your deposited Izzyship wallet account.

  2. Upon receiving your order request, our system will review your order, check the contents of Parcel and/or Cargo, repacking depending on your choice i.e. materials, size, etc. We will notify you via our email cs@izzyship.my once the Parcel and/or Cargo is ready for shipment. You may login to your account to review its chargeable weight, total shipping costs, before you proceed to confirm the order and make the payment via your Izzyship wallet account in order for us to proceed with the release of shipment.

29. WEIGHT AND CAPACITY MEASUREMENT (PARCEL AND/OR CARGO STANDARD LIMITATION PER UNIT)
The method of measurement and calculation of freight weight shall be based on the type of Services engaged as set out below based on per unit standard limitation:

i. AIR FREIGHT (Parcel)

Dimension Formula :

  • Length (cm) × Width (cm) × Height (cm) ÷ 6000 = Volumetric Weight (kg)

​Remarks:

  1. The weight of freight shall be determined based on the actual weight or volumetric weight, whichever is higher.

  2. With regard to shipment’s chargeable weight, any fraction of a KG will be rounded up to the next KG. (e.g. 2.55kg will be charged at 3.0kg)

  3. The minimum volume is 5kg, and the minimum unit for billing is 1kg. 

  4. If the Parcel package exceeds any of the standard limitations, a stevedoring surcharge will be incurred.

b. SEA FREIGHT

ii. Bulk Cargo

  • Length (cm) × Width (cm) × Height (cm) ÷ 2500 = Volumetric Weight (kg)

​Remarks:

  1. The weight of freight shall be determined based on the actual weight or volumetric weight, whichever is higher.

  2. With minimum volume is 0.3m³/120kg, and the minimum unit for billing is 0.0025m³/1kg. (e.g. 1.0033m³ will be charged at 1.0050m³)

  3. The rate of G300+ Cargo will be provided with a special quotation upon request.

  4. If the cargo package exceeds any of the standard limitations, a stevedoring surcharge will be incurred.

 

30. SHIPPING FEES
The final shipping costs will be determined by the Izzyship system after reviewing your order. You are responsible for payment of all shipping costs and applicable fees (if any), even if they are different from the original estimated cost. You will be liable for additional shipping costs for shipment seized or confiscated by the relevant customs authorities and/or surcharge on special handling due to the inaccurate or incomplete information provided by you.​

31. THIRD PARTY LOGISTICS
Izzyship reserves the right to appoint and/or collaborate with other logistic companies to provide delivery services at selected areas.

32. SURCHARGES

  1. Surcharge is applicable for overweight or oversized orders or shipment.

  2. Surcharge is applicable for overdue or late payment.

  3. Surcharge is applicable to special items wrongly declared as normal items.

  4. Surcharge may be applicable to special request shipment.

  5. Surcharge is applicable to shipment with misleading product descriptions or under- declared value on the cargo contents being seized or confiscated by the relevant Customs authorities.

  6. For priority service, surcharge is applicable to normal products that come with batteries and magnets. However, priority service is not applicable for pure batteries under special terms.

  7. Surcharge is applicable for addresses fall under the outskirts area.

  8. Surcharge is applicable to handling of shipment that failed to be delivered due to incorrect or incomplete delivery address given; unavailability of the recipient which had moved out from the address; unavailability of the recipient which had left the company and the company refused to receive the shipment; request by the recipient to change the delivery service provider or delivery address.

33. DUTIES & TAXES
International shipments are subject to duties and taxes as determined by customs in the destination country. You will be responsible for payment of all charges, including but not limited to, all duties and taxes, custom charges, as well as SST applicable to your shipment (if any).


34. ORDER CANCELLATION
Upon submission of your order, you are not allowed to cancel your order. You shall not make changes to the information submitted (adding or deleting information regarding consignee, address, shipping method).


35. PAYMENT METHOD

  1. You must retain a sufficient amount for payment of your total shipping cost process.

  2. Once the final shipping fees for your shipping order is generated by our system, an invoice will be sent to your email. Upon the day of issuance of invoice, you are required to make the payment within three (3) days.

  3. If any sum due is not made on the date of issuance of invoice within three (3) days, a late rate of 1.5% per day will be charged based on the amount stipulated in the invoice against you from the 4th day after the date of issuance of invoice until the date on which it is paid in full

  4. Izzyship reserves the right to debit your Izzyship wallet account for any outstanding freight charges on Parcel and/or Cargo, storage fee and any related charges applicable to you.

36. RELEASE OF SHIPMENT
A notification will be sent to your Membership Portal once your shipment has been released.


37. PARCEL AND/OR CARGO STORAGE & FEES
Fees of storage for Parcel and/or Cargo shall be incurred for :

  1. Parcel/Cargo with “pending payment” status.

  2. Unknown status of customer information regarding their respective parcel/cargo on arrival at the Izzyship’s Malaysia Warehouse.

​Parcel /Small Parcel at Izzyship’s China Warehouse

  1. Once the invoice been issued for Parcel or Small Parcel and payment has not been received by Izzyship within three (3) days, the calculation of charges for storage is set out as follows:

  2. On the 4th day onwards, the charges will be incurred for fourteen (14) days inclusive of weekend/weekday/public holiday for each order or per consignment no. The rate of charges shall be RM10.00/per day.

  1. If the payment of Parcel or Small Parcel has been pending for more than 17 days, Izzyship will proceed to dispose of the Parcel or small Parcel on the 18th day, without further notice or compensation. Notwithstanding the disposal of the Parcel or Small Parcel by us,     you shall be liable to bear any storage fee incurred for the storage of the Parcel or Small Parcel.

  2. The storage for both sea freight and air freight Parcel or Small Parcel for consolidation process shall be complimentary for 30 days from the date of arrival at Izzyship’s China Warehouse. Storage charges will be incurred starting from 31st day onwards, the calculation of charges is set out as follows:

    1. On the 31st day onwards, the charges will be incurred for two weeks (14 days) inclusive weekend/weekday/public holiday for each order or per consignment no. The rate of charges shall be RM10.00/per day.

Cargo at Izzyship’s Malaysia Warehouse

  1. Free warehouse usage: 3 working days (per consignment note)

    1. Calculation of number of days: starts from the day of Cargo is confirmed and received by the warehouse and has entered the warehouse management system at the warehouse.​

  2. Calculation of charges: starts when the Cargo has been stored more than 3 days. On the 4th day onwards, the charges will incur for two weeks (14 days) inclusive weekend/weekday/public holiday for each order or per consignment no. The rate shall be RM0.50 per kg/per day.

  3. Izzyship shall, for all Cargo received for more than 17 days, it shall be disposed of on the 18th day, without further notice or             compensation. Notwithstanding the disposal of the Cargo by us, you shall be liable to bear any storage fee incurred for the storing of the Cargo.

38. MISCELLANEOUS CHARGES/ADD ON SERVICE

  1. If we discover that your Parcel and/or Cargo is not packed appropriately upon receiving, we will notify you and an add-on service charges will be imposed for the repackaging of your Parcel and/or Cargo to ensure that the packaging is well organized and secured for shipment. We shall not be liable for any damaged Parcel and/or Cargo if you refuse such service provided by us.

  2. In the event that you require any additional services as stated below for your Parcel and/or Cargo, an extra charge will be imposed for each additional service. The additional services provided are as follows:

    • “Fragile” Sticker;

    • Wooden Frame;

    • Pallet and Stretch Film;

    • Pallet and Wooden Frame;

    • Fibred Bag or Woven Bag;

    • Packed Carton;

    • Gunny Bag or Sack;

    • Packing Belt;

    • Label Stickers; or

    • Bubble Wrap

 

39. PENALTY CHARGES
Izzyship shall impose a penalty charge to the customer for changing the address and shipping method of consignment that has been loaded into the container or after the container manifest has been generated.


40. DISPOSAL OF PARCEL AND/OR CARGO
You may request for disposal of your Parcel and/or Cargo if you are no longer wished to ship your item. Upon confirmation of disposal, you agree to authorize Izzyship to dispose of your Parcel and/or Cargo. This action is not reversible. A disposal fee will be charged to your account at sole and absolute discretion.​

 

41. APPOINTMENT OF Izzyship AS AGENT

  1. The Services that Izzyship provided are the provisions of the platform which constitute a technological platform that enables you to arrange and/or schedule transportation, logistical and/or delivery services for goods, whereby the platform will facilitate and connect you with a logistic service provide which will provide you with such as transportation, logistical and/or delivery services.

  2. You agree and acknowledge that Izzyship is not your agent or the agent of the logistic company and that:

    1. Neither Izzyship nor the courier service have the authority to bind each other; and

    2. Izzyship is not a party to the contract for the hiring of the courier services.

42. INTERNATIONAL SHIPMENT AND DELIVERY
Izzyship will make every reasonable effort to deliver the shipment to you according to the shipper or courier company’s regular schedules, but these are not guarantees and do not form part of the agreement between us. Izzyship is not liable for any delay, loss or damage caused by delivery company’s delay.


43. DELIVERY TIME
Delivery time that is provided by us is only an estimated time of delivery and shall not be construed as exact delivery time. The delivery time shall be calculated based on the total amount of time required to process an order which includes packaging, transit time to delivery service provider, and transit time to the delivery address. We will make every effort to deliver within the given estimated delivery time. However, please expect delays during peak seasons e.g. festive seasons or any unforeseen circumstances. Izzyship is not liable for any loss of sales or any 3rd party penalty due to delays or whatsoever during the transit time.

44. COMPLIANCE TO EXPORT AND IMPORT LAWS
You acknowledge and agree that:

  1. You will comply with all law or regulation of any federal, state or local government in the origin or destination countries;

  2. Izzyship is not liable for any delay will at all times comply with all applicable export and import laws when it comes to international freight and forwarding. We shall reserve the right to refuse to process any Parcel and/or Cargo that requires an export or import license and/or any parcel which Izzyship is not liable for any delay reasonably believe or suspect in violation of any law or regulation of any federal, state or local government in the origin or destination countries; and

  3. You will not use or attempt to use Izzyship to receive or send any items that are specially designed, modified, adapted, or configured for a military application; or any dual use items that are subject to export license requirements; or any products that are intended to be used in chemical biological weapons, missile technology or nuclear proliferation.

45. CIRCUMSTANCES BEYOND OUR CONTROL
Izzyship
is not liable for any delay, loss or damage to your shipment arising out of circumstances beyond its control. These included but are not limited to natural disasters (for example, fire, earthquake, hurricane, tsunami, tornado, storm, flood, fog); plane crash or embargo; war, riot, civil commotion, or industrial action; epidemics or pandemics; power cuts, communications or other utility disruptions; governmental action or inaction; any defect to the nature of a shipment; and damage or erasure to electronic or photographic images, data or recordings due to electrical or magnetic interference.


46. PRODUCT RETURNS OR EXCHANGES
We do not provide any return nor exchange services. After the shipment has been delivered, if you wish to return the parcel/cargo to the merchant from which you purchased it from, you will need to make direct arrangements with the supplier as soon as possible for any return, refund, or exchange of items in accordance with the merchant’s terms and policies.


47. CLAIMS & INSURANCE
Izzyship
is not liable for any delay shipments from the period of the Parcel and/or Cargo departed from Izzyship’s China Warehouse to the destination address provided by you.

AIR FREIGHT

  1. Insurance: the total value per consignment note in respect of such shipment exceeding RM500.00, the sender may purchase an insurance policy with Handling Insurance Coverage; HIC, from Izzyship to insure his own goods at a rate of 1% of the shipment total value. Optional HIC is made available upon request.

  2. Liability Terms: upon loss or damage, Izzyship’s total liability in respect of such shipment shall be limited to its actual cost or value but in any event shall not exceed RM200.00 (“Indemnity”). Upon the goods of the indemnified party are compensated, the Indemnity will no longer have the ownership of the damaged goods.

 

SEA FREIGHT

  1. Insurance: the total value per consignment note in respect of such shipment exceeding RM500.00, the sender may purchase an insurance policy from Izzyship to insure his own goods at a rate of 1% of the shipment total value. Optional HIC is made available upon request.

  2. Liability Terms: upon loss or damage, Izzyship’s total liability in respect of such shipment shall be limited to its actual cost or value but in any event shall not exceed RM500.00 (“Indemnity”). Upon the goods of the indemnified party are compensated, the Indemnity will no longer have the ownership of the damaged goods.

b. The insured items under our insurance policy shall exclude the following:-

  • bullion;

  • cash securities and other cash equivalents;

  • goods which are banned, prohibited or otherwise excluded by any law, regulation or statute of any jurisdiction from which the property is collected, delivered, or through which the property is transported;

  • live animals or plants;

  • perishable goods (including any frozen/refrigerated goods);

  • precious jewellery, metals, stones;

  • temperature sensitive goods;

  • any property which the Policyholder and/or Transport Provider specifically excludes from shipment under the Consignment Note / CNID, and any liability arising from the shipment of such excluded property;

  • antiques works of arts, specie/fine art, curios;

  • alcohol beverages;

  • tobacco products;

  • micro chips, precision tools, high-tech and sophisticated machinery;

  • lead/tin ingots, chinese herbs, chinese medicine;

  • bulk cargo of all types without packing - including all chemicals, oil or oil products;

  • fragile items including but not limited to glass items, laboratory materials, musical instruments, porcelains, optical instruments;

  • all ordinance equipment; or

  • explosive foods of a dangerous nature; 

c. Izzyship shall not be liable for any loss, damage or expenses caused by the delay, even though the delay may be caused by a risk insured against.
d. Izzyship shall not be liable for any loss, damage or expenses caused by insufficiency or unsuitability of packing or preparation by the sender for any Parcel, Small Parcel or Bulk Cargo.

48. CLAIMS

  1. Any claims shall be made in writing with relevant documentation i.e. remarked and signed delivery order and email to cs@izzyship.my within 48 hours from the date of the shipment was delivered to you, failing which, we will not be liable for any loss in any way. Claims must be accompanied by photos, scanned copies of the original documents, and relevant original invoices and receipts for that item.

  2. Damaged and Missing item

    1. Clear pictures of the external of the Parcel and/or Cargo. This includes images of the top and bottom of the Parcel and/or Cargo  as well as any areas where tape and labels were attached.

    2. Clear pictures of all areas of damage to the Parcel and/or Cargo .

    3. Clear pictures of the internal of the Parcel and/or Cargo .

    4. Clear pictures of the packing material used. This includes, but not limited to, manufacture packing, bubble wrap, paper, etc.

    5. Clear pictures of all areas of damage to the Parcel and/or Cargo . If multiple Parcels and/or Cargos were damaged, please provide a clear and visible photo for all affected Parcels and/or Cargos. 

  3. If the above information required is not received within the time frame listed above, Izzyship reserves the right to not entertain or reject any claim.

49. INQUEST
You may reach us at cs@izzyship.my. For any inquiry, we will review and render necessary information to you within 24 hours.


50. TERMINATION
You may terminate your Izzyship’s account at any time by reaching us at cs@izzyship.my. We will notify you in 24 hours. Izzyship reserves the right to suspend or terminate your account if you breach any of the terms and conditions, or if we have discovered any unlawful use of your account. All outstanding payment obligations under this Agreement are still liable after such termination. Your account will be terminated if the system detected such account has been inactive for more than 6 months. Izzyship will process all your outstanding balance and deduct if any, and the balance fund will be refunded in 3 months into your personal local bank account.


51. TOP UPS AND PROMOTIONS
All top up credits must be accepted as rewarded and are not replaceable, transferable, refundable, exchangeable for cash or kind or extendable in validity. Izzyship reserves the right to substitute the gifts, credits, vouchers, etc with others of equivalent value without prior notice. In the event of a termination occurrence, clause 50. applies. Izzyship reserves the right to cancel, not to return and refund any promo item; and all gifts, credits, vouchers, promotions, etc. without prejudice 


52. INDEMNITY
You agree to indemnify, defend and hold Izzyship and its shareholders, officers, directors, affiliated companies, employees and agents harmless from all claims, losses, damages, liabilities and costs (including reasonable legal fees) incurred which result from your use of Izzyship website and Izzyship Services, including but not limited to your negligent act or omission, any misrepresentations you make in connection with obtaining Izzyship’s Services, any incorrect declaration of contents or value of shipment for export purposes, and/or your failure to comply with these terms and conditions.

53. ENTIRE AGREEMENT
These terms and conditions constitute the entire agreement between us for the use of the Izzyship website, your use of your account, and the provision of Services. These terms and conditions supersede all other written or oral statements.


54. SEVERANCE
These terms shall apply to the fullest extent permitted by applicable law. If any part of these terms is rendered void, illegal or unenforceable by any legislation, this will not affect the enforceability of any other provisions.


55. GOVERNING LAW AND JURISDICTION
These T&C of this Agreement, and any interpretation or dispute arising therefrom, shall be made in accordance with, and shall be within the exclusive jurisdiction of the laws and courts respectively of Malaysia.


56. CONFLICT OF INCONSISTENCY
If there is any conflict or inconsistency between the Chinese version of the terms and conditions and this English version of the terms and conditions, the English version of these terms and conditions shall prevail.
